A GoFundMe campaign has been launched to support Nelson Shardey, a retired 75-year-old Ghanaian man who has lived in the UK since 1977. His story is both urgent and heart-wrenching.

Background:

  • Nelson was a larger-than-life figure in the Wallasey community, known for his shop, Nelson’s Newsagents. During the pandemic, he even provided home delivery services, acting as a lifeline for many.
  • In 2007, he received a “Mersey Marvel” award after saving a friend from a brutal attack by a masked robber.
  • However, a few years ago, Nelson discovered that he was not officially considered British, despite believing otherwise. In 2019, when he sought legal assistance to apply for a British passport, he was informed that he had no lawful basis to be in the UK.
  • Despite living and working in the UK for over 40 years, paying taxes, having a mortgage, serving on a jury, and contributing to charity work, he faced this devastating revelation.

Legal Battle and Financial Strain:

  • Nelson was granted 2.5 years of limited leave to remain in the UK on the 10-year route to settlement. This means he would need to spend an additional 10 years in the UK before being eligible to apply for indefinite leave to remain (ILR).
  • Unfortunately, in 2022, he lost his limited leave to remain due to an application error. The Home Office never informed him of this mistake.
  • Despite undergoing cancer treatment during this period, Nelson was wrongly advised that he might be eligible for British citizenship under the Windrush Scheme. However, his application was eventually rejected.
  • Now, at 75 years old, Nelson faces the prospect of reapplying for limited leave to remain four more times, paying thousands in visa fees over the next decade, and not receiving ILR until he is at least 84.

The GoFundMe Campaign:

  • Nelson’s family, including Jacob Shardey and Aaron Shardey, have organized a fundraiser to challenge the Home Office’s unfair treatment.
  • The campaign aims to raise funds for legal costs (estimated at £18,000) to secure Nelson’s right to remain in the UK.
  • So far, the campaign has raised £21,000, but the financial burden remains significant.
